Exhibit binders are organized compilations of evidence, documents, or materials submitted during pretrial motions, hearings, or trials in federal court. In the Central District of California (CACD), which includes courthouses like the Edward R. Roybal Federal Building (255 E. Temple St., Los Angeles) and the Spring Street Courthouse, binders must comply with the Federal Rules of Civil Procedure (F.R.Civ.P.), Federal Rules of Evidence, and CACD Local Rules to avoid rejection or sanctions. These rules emphasize proper formatting, numbering, and presentation for clarity and judicial efficiency. Non-compliance can lead to exhibits being excluded.

Key CACD Local Rules for Exhibits and Binders

From the CACD Local Rules (effective June 1, 2025, Chapter I: Local Civil Rules), exhibits attached to filings or presented at trial have specific requirements:

  • L.R. 11-5: Exhibits to Documents
    • Numbering and Attachment: Paper exhibits must be attached to the main document, numbered sequentially (e.g., Exhibit 1, 2), with tabs or dividers. Use exhibit tags on the upper right corner.
    • Size and Format: Exhibits should be on 8.5 x 11-inch paper where possible. Oversized or irregularly shaped items may be lodged physically rather than filed electronically.
    • Nonpaper Exhibits: Physical items (e.g., objects, media) cannot be filed electronically; lodge them with the Clerk or submit at trial/hearing per L.R. 79-3 or 79-4.
    • Small Exhibits: If under 8.5 x 11 inches, mount on standard paper.
  • Trial-Specific Preparation (e.g., Court Trial Order)
    • Use three-ring binders for voluminous exhibits, indexed by number with tabs on the right side. Avoid metal fasteners.
    • Submit an original and one copy to the court on the first day of trial. Label binders on the spine with volume number and include an internal index.
    • Tag originals with court exhibit tags (case number, name, exhibit number) stapled to the front upper right.
    • Exhibit lists must note objections, reasons for objection, and admissibility arguments. Failure to object waives it.

Additional best practices: Number pages within multi-page exhibits for easy reference. For electronic filings via CM/ECF, scan exhibits as PDFs (searchable if possible) and attach them; physical binders are for in-court use. Consult individual judges’ standing orders or procedures on the CACD website (cacd.uscourts.gov) for variations.

Preparation Tips

  1. Organize Early: Meet and confer with opposing counsel on exhibits to resolve admissibility stipulations.
  2. Contents: Include cover sheets, indexes, and tabs. Use color printing for clarity (e.g., charts, photos).
  3. Copies: Provide sets for the judge, clerk, witnesses, parties, and jury (if applicable—e.g., 5 binders for a two-party case).
  4. Lodging/Filing: Lodge physical binders with the Clerk if not e-filed; deliver to courtroom on trial day.
  5. Compliance Check: Review F.R.Civ.P. 16/26 and L.R. 16 for pretrial disclosures.
